According to the Federal Motor Carrier Safety Administration (FMCSA), coercion occurs when a motor carrier, shipper, receiver, or transportation intermediary threatens to withhold work from, take employment action against, or punish a driver for refusing to operate in violation of hours-of-service and other safety regulations including certain provisions of the Federal Motor Carrier Safety Regulations (FMCSRs), Hazardous Materials Regulations (HMRs) and the Federal Motor Carrier Commercial Regulations (FMCCRs).  An example of coercion occurs when a motor carrier terminates a driver for refusing to accept a load that would require the driver to violate the hours of service (HOS) requirements.

To address the problem of coercion, the Federal Motor Carrier Safety Administration adopted the Prohibiting Coercion of Commercial Motor Vehicle Drivers, known as the Coercion Rule which took effect on January 29, 2016.  The Rule allows drivers to report incidents of coercion to the FMCSA and authorizes the administration to issue penalties against motor carriers, shippers, receivers, or transportation intermediaries.

Does economic pressure in the motor carrier industry affect commercial drivers in such a way that it creates a negative impact on safety?  Why or why not?  Will the Coercion Rule have a greater impact on the economic side of the commercial trucking industry or safety?  Describe your answer.

Essay Topic And How To Apply:Bicycle Accident Prevention

In today’s changing traffic climate, bicycling as a means of commuting to school and work is increasing in nearly all urban areas. As a result, interactions between bicyclists and motor vehicle drivers have increased, placing the safety of cyclists at risk.

The National Highway Traffic Safety Administration reported that 743 people in the United States lost their lives in bicycle accidents in 2013 alone and that 68 percent of those deaths happened in urban areas. That same year saw more than 48,000 injures from bicycle collisions.

The harm caused by these collisions extends far beyond the scene of the crash as victims often endure pain and suffering, bear the financial toll of medical expenses and lost wages, and may struggle to provide for themselves or their families as they recover from their injuries. In the tragic event that a cyclist loses her life in an accident, that victim’s loved ones will never be able to recover completely from their loss. Consequently, it is in everyone’s best interests to consider topics related to bicycle safety and to do their utmost to act in a manner that promotes safe riding in their communities.

Scholarship applicants are required to do the following:

  1. Fill out a biographical information form.
  2. Write an essay on one or more of the following topics/issues:
    1. Relevant safety steps that bicyclists and motorists can take to avoid traffic accidents;
    2. The role that local, state, and federal government can play in improving bicycling in urban areas, including the reduction of collisions between bicyclists and motor vehicles; and
    3. Any personal experiences you have had with bicycle safety and/or collisions, the results of those experiences, and how your opinions on bicycle safety have been affected as a result.

The essay should not exceed 1,000 words. Please cite/credit any sources you have used to support your essay (such as news stories or government statistics).

  1. Email your information form and essay to info@abelsannes.com. The subject line of your email must include the words “Abels & Annes, P.C. Scholarship Essay Application.”

Details on the application process are as follows:

  • Essays must be responsive to the question posed above
  • Applications should be emailed to: bolingricelaw@gmail.com

Requirement:

In 750-1000 words, prepare a written response that addresses one of the following prompts:

  1. Some of the best life lessons are the ones we learn from our mistakes.  Share a lesson you learned when facing the consequences of bad decision making as a driver of a passenger.  Describe the situation and explain how it led to a valuable learning experience

  2. Learning how to drive is a different experience for everyone because some may find it easy to accomplish while others struggle with the challenge.  Describe your experience.  What did it take for you to become a confident driver?  What valuable lesson(s) did you learn about yourself, others, or life in general during or after the process?

  3. You may have noticed that people tend to change over time.  For example, you’re probably not the same person you were as a freshman in high school.  Think about the driver you were when you first obtained your driver’s license.  Maybe you were a young and reckless driver or perhaps a timid and careful driver.  Now think about the driver you are today.  Describe how you have changed as a driver.  Does this transformation reflect changes in other aspects of your life.  If so, explain.  Would you consider this transformation to your benefit or do you see it as a potential problem?  Why?

  4. Although the vast majority of the country’s population drives on a regular basis, there are still many people who do not.  Are you one of them?  What’s keeping you from getting behind the wheel?  Maybe the city you live in is not commuter-friendly, maybe you cannot afford to buy a car, or perhaps you simply choose not to drive.  Describe your situation.  Is this an obstacle for you?  Why or why not?  How has not driving influenced you and your life?

Visit the scholarship application page and follow the directions for completing your submission.
